Estudio sobre la interpretación del artículo 231 CRBV por la Sala Constitucional del Tribunal Supremo de Justicia / A study on interpretation of article 231 CRBV from the Constitutional Chamber of the Supreme Court of Justice

Resumen

En este trabajo se analiza la sentencia de la Sala Constitucional del Tribunal Supremo de Justicia 2/2013, de 9 de enero, en la que se interpreta el artículo 231 de la Constitución de la República Bolivariana de Venezuela (CRBV), decidiendo que el presidente reelecto puede tomar posesión del cargo y juramentarse en una oportunidad distinta al diez de enero del primer año de su nuevo mandato, sin que el incumplimiento de este requisito constitucional suponga el cese del ejercicio de sus funciones, y en definitiva, la existencia de una falta temporal o absoluta. Esta investigación documental se basa en los argumentos expuestos por la Sala Constitucional en esta y otras decisiones relacionadas, así como en la historia constitucional venezolana. Se concluye que la Sala estableció una interpretación que favoreció el estatus político del gobierno del presidente Chávez, evitando la transición que hubiera originado la declaratoria de una vacante en la presidencia.

Abstract
In this paper we analyze the decision 2/2013, of January 9th, of the Constitutional Chamber of the Supreme Court of Justice, which interpreted the article 231 of the Constitution of the Bolivarian Republic of Venezuela (CRBV), in terms of establishing that reelected president can take office and sworn on a day other than January 10th of the first year of his constitutional term, without breach of this constitutional requirement involves the cessation of the exercise of his functions, and then, a temporary or permanent absence. This documentary research is based on the arguments set out by the Constitutional Chamber in this and other decisions, and in the Venezuelan constitutional history. We conclude that the Chamber stated an interpretation that favored the political status of President Chavez’s government, avoiding the transition that would have caused the declaration of presidential vacancy.
